PEF unit-determination challenge nets 40 members
PEF has registered a net gain of 40 members in an interim decision of the Public
Employment Relations Board’s director of representation.
The PERB decision reflects a settlement between PEF and the Governor’s Office of
Employee Relations on bargaining unit challenges affecting 164 state employees.
Some of these challenges have been pending since 1998. The bargaining-unit
designations of more than 1,000 employees have been challenged.
This decision moves 45 employees from the Management/Confidential (M/C) Unit to
the Professional, Scientific and Technical (PS&T) Unit, which is represented by
PEF.
However, five employees are moved from the PS&T Unit to M/C. And the M/C status
of 114 employees, who were challenged by PEF, has been upheld.
“We have a number of unit-determination challenge petitions pending,” said PEF
General Counsel William Seamon. “We work closely with Bob Carrothers, PEF’s
director of contract administration, on processing the petitions.”
Carrothers said the state Taylor Law puts the burden of proof on the employer to
defend M/C designations.
“The law advantages us, but the process does not,” Carrothers said. “It requires
the duties of each employee be reviewed and assessed individually (no matter how
many have the same job title) to determine if they meet the criteria for M/C
designation.”
“I’m hopeful we can resolve more of these soon,” Carrothers said.
