30-minute miscalculation shorted SED hourlies $200 on ’04 bonus
It’s been a long time coming, but a sizeable group of PEF members at the state
Education Department who were shortchanged $200 on the April 1, 2004, contract
bonus of $800 finally have been paid.
Last October, an arbitrator ordered the state to pay dozens of hourly employees
the missing $200. Those payments were made March 29 following the
recalculations.

PEF Executive Board member Christine Kleinegger worked with PEF associate
counsel Elizabeth Hough and field representative Jim Hair to recruit grievants
and obtain the voluminous documentation needed to support the union’s
class-action case.
That case was based on a simple fact — SED had used eight hours for a full-time
day in its formula to pro-rate the hourly workers’ bonus payments. PEF said that
was wrong because SED’s full-time employees work 7.5 hours per day or 37.5 hours
per week.
The formula, specified in the PS&T contract, for pro-rating the bonus for
part-time employees creates a scale stepped-down by $200 at each of three
levels. The use of eight hours as the full-time standard pushed nearly all
hourly employees down one notch. Even those working a full 37.5-hour week were
shorted.
The grievance was denied by SED at Step 2. PEF appealed to Step 3 and it was
referred for triage processing under an arbitrator who secured the settlement
