Parole wins out-of-title grievance

Division 236 members in the state Division of Parole (DOP) received a favorable outcome after filing an out-of-title grievance nearly two years ago.

According to Richard Mata, a PEF Executive Board representative for DOP, four or five facility parole officers were pulled from their prison positions in the Rochester area and assigned to work in the field.

Mata said some officers received over-time pay, others straight-time. But they were all working out-of-title.

“This is just another example of managers doing things whether it’s right or wrong, knowing it takes considerable time to have these matters decided by others,” Mata said.

An Article 17, or out-of-title, grievance undergoes a high level of scrutiny and is a lengthy process. The employer or agency and the Governor’s Office of Employee Relations review the grievance and a decision is handed down after a review from the state director of classification and compensation.

The agency rejected the grievance, but PEF appealed and won. The decision was announced in late July.

“This is a wonderful and just outcome,” said Manuelita Clemente, Division 236 council leader. “It is also another example of how the agency believes it is running properly, when in actuality it is not.”
