Deadline nears for OT meal allowance claims

Eligible PEF members can start cashing in on overtime meal allowances, as the union and state reached agreement in February on a process for identifying employees who were eligible to receive overtime meal allowance enhancements for the period from April 1999 through August 2000. 

Last year, Arbitrator Tia Denenberg agreed with PEF that overtime meal allowance enhancements in the 1999-2003 NYS/PEF Agreement had to be implemented retroactive to April 2, 1999 and not in January 2000 as the state claimed. “The recent agreement finally establishes a process for identifying who is eligible to receive these benefits.” said PEF associate counsel Elizabeth Hough. “Members with claims during those 16 months may now submit them for reimbursement.”

One of the contract enhancements, according to Hough, was the extension of the OT meal allowance to eligible PS&T employees in grade 22 and below. And a second meal allowance was added for employees who work longer amounts of overtime in a day — at least six hours beyond their regular shift on a regular workday, or at least nine hours on a pass day.

Eligible employees must submit completed claim forms to their agency and documentation. Generally, documentation will be time and attendance sheets. However, agencies may accept other state records for documentation of an employee’s claim. Retroactive OT meal claims must be submitted no later than Friday, April 16, 2004.

Employees on the administrative payroll can expect to see the payment of approved claims in checks dated June 2. Those on the institutional payroll will see their payment in the check dated June 10.

Members whose OT meal allowance claims are denied may submit them to their PEF field representative for review by PEF and possible appeal to GOER.
